What to Do in a Motorcycle Crash With a Car

The moments after a motorcycle crash can be chaotic. The motorcyclist is generally injured and in shock. Still, it’s important to protect your legal rights. If you’ve been in an accident, here’s what to do:

Check for Potential Injury

In a collision with a car, truck or other vehicle, it’s the motorcyclist who’s most likely to be injured. Still, check on the driver and others around you so you can report injuries accurately.

Call 911

Police are dispatched to every major traffic accident, but if you can, do call 911 anyway. Making the call yourself will ensure help arrives as soon as possible. Be certain to mention if anyone is hurt, bleeding or unconscious.

Photograph the Scene

With a mobile phone or other camera, photograph the scene as best you can. Most importantly, get photos of your motorcycle, other involved vehicles, everyone at the scene including the other driver and yourself, the area surrounding the accident, and your injuries.

Don’t Accept Blame

Be aware that a driver or that person’s insurance company can use any statement you make at this point against you. Don’t apologize or state that you didn’t see a car, light or stop sign. You don’t have to say anything about liability at all. Less is more.

Get Insurance Information

The driver involved in your accident may or may not wish to cooperate with you. Still, you should PHOTOGRAPH:

  • insurance,
  • driver’s license,
  • and contact information.
  • Get the license plate number of the vehicle.

Get Information from Witnesses

You do not need to try to take “statements” from witnesses, but you should get the names and phone numbers of anyone who saw the accident and can clarify what happened.

Speak to the Police

You can talk to the police, but continue avoiding statements of blame until you have spoken to an attorney. Find out how you can get a copy of the officers’ report.

See a Doctor

A complete medical checkup is essential after any accident. Even “minor” head trauma can lead to serious medical consequences. The symptoms can take days to appear! If you have any pain and an ambulance is offered, take it.

Have Your Motorcycle Evaluated

A qualified motorcycle mechanic should look at your motorcycle to determine the extent of the damage and costs of repair. This also helps to rule out mechanical failure as an accident cause.

Contact Your Insurance Firm and a Motorcycle Accident Lawyer

You should alert your insurance company about the accident right away, but don’t make any detailed statements. A qualified accident lawyer can help you by taking over communication with others involved in the case.
